WHAT TYPE OF SURVEY DO I NEED?
Our expert witness surveyors can provide expert witness reports on a variety of issues. They are normally required in connection with disputes for use as evidence to identify the facts of the case. Matters covered by the expert witness reports could include value, building defects or boundary matters.
Often the expert witness report will be confined to the provision of a written statement or report but, in some cases, could include giving oral evidence in a court. In most cases, the expert witness report will be prepared in accordance with Part 35 of the Civil Procedure Rules and for the benefit of the Court. It can be provided for either party to a dispute, but sometimes, the surveyor acting as an expert witness will be appointed jointly by the parties.
The expert witness surveyor will take a completely independent view as his duty is to the Court rather than either party. The expert witness report will follow the RICS Practice Statement & Guidance Note "Surveyors Acting as Expert Witness".
When facing property disputes, boundary issues, or construction defects, selecting the right expert witness surveyor is crucial for a successful case outcome. A qualified expert witness surveyor brings independent, credible evidence to assist arbitrators, mediators, or courts in understanding the complexities of property and land matters. Here are key factors to consider:
Specialist Expertise: Choose a RICS-qualified expert witness surveyor with relevant experience in areas such as land disputes, building defects, or valuations.
Impartiality: The expert witness surveyor should maintain independence and objectivity, providing unbiased evidence rather than acting as an advocate for any party.
Communication Skills: Select a surveyor who can clearly explain technical matters in both written reports and oral testimony.
Legal Experience: A strong legal background is essential; the surveyor should produce compliant reports and present credible testimony under cross-examination.
Expert Training: Prioritise surveyors who have completed expert witness training, ensuring they understand legal requirements and standards.
Credibility: The surveyor should have a solid reputation, demonstrating professionalism, integrity, and reliability.
